BMS WhatsApp API Terms and Conditions

1. Introduction

Welcome to BMS. By accessing our WhatsApp API, you agree to be bound by these terms and conditions. Please read them carefully.

2. Acceptance of Terms

By using our services, you signify your agreement to these terms. If you do not agree to the terms, you must not use our services.

3. Service Description

BMS provides an unofficial WhatsApp API that enables automated messaging capabilities. This API is not affiliated, authorized, maintained, sponsored, or endorsed by WhatsApp Inc.

4. User Obligations

You agree to use the API responsibly and within the legal boundaries. You shall not use the API for sending spam, unsolicited messages, or any content that is unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable.

5. Compliance with Laws

You are responsible for ensuring that your use of the API complies with all applicable laws and regulations, including but not limited to data protection and privacy laws.

6. Service Modifications and Availability

BMS reserves the right to modify or discontinue, temporarily or permanently, the service (or any part of it) with or without notice. You agree that BMS shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.

All intellectual property rights in the API and all content provided through the API are the property of BMS or its licensors. You agree not to duplicate, copy, distribute, or resell any part of the API or access to the API.

8. Termination

We may terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including if you breach the terms.

9. Limitation of Liability

In no event will BMS be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the service.

10. Indemnity

You agree to indemnify and hold BMS, its officers, directors, employees, and agents harmless from any claims, demands, losses, liabilities, and expenses (including attorneys' fees), arising out of or in connection with your use of the API or services or your violation of these terms or the rights of any third party.

11. Governing Law

These terms shall be governed and construed in accordance with the laws of Ujjain, Madhya Pradesh, without regard to its conflict of law provisions.

12. Changes to Terms

BMS reserves the right, at our sole discretion, to modify or replace these terms at any time. If a revision is material, we will try to provide at least 30 days' notice before new terms take effect.

14. Disclaimer of Responsibility for WhatsApp Account Blockage

14.1 Accountability

You acknowledge and agree that BMS provides an unofficial WhatsApp API, and its use may be in violation of WhatsApp's official terms of service. Usage of our API can potentially lead to the suspension or blocking of your WhatsApp account by WhatsApp Inc.

14.2 Risk Acknowledgment

By using our API, you accept all risks associated with the potential blocking or suspension of your WhatsApp account. BMS will not be held responsible for any disruptions, suspensions, or terminations of your WhatsApp service linked to or resulting from the use of our unofficial API.

14.3 No Liability

BMS shall not be liable for any claims, damages, or losses incurred by you or any third party arising out of or in connection with the suspension, blocking, or termination of your WhatsApp account. This includes but is not limited to lost profits, business interruptions, or loss of data.

14.4 User Responsibility

It is your responsibility to ensure that your use of our API complies with all relevant laws and guidelines, including those set forth by WhatsApp. We strongly recommend reviewing and understanding WhatsApp's terms of service to evaluate the compliance of our API with their policies.

15. Jurisdiction

15.1 Governing Law

These terms shall be governed and construed in accordance with the laws of Ujjain, Madhya Pradesh, without regard to its conflict of law provisions.

15.2 Jurisdictional Agreement

You agree that any legal actions, suits, or proceedings arising out of or related to these terms and conditions, or your use of the service, shall be brought exclusively in the courts located in Ujjain, Madhya Pradesh. You hereby accept and submit to the personal jurisdiction of these courts for the purposes of any such legal actions.
